From Patents to Investment: Unlocking Startup Growth
The core message of the session was that patents and other intellectual property rights are not a legal afterthought for technology startups; they are a practical mechanism for creating defensible value, attracting capital, and improving the odds of scaling or exiting successfully. The moderator opened by explaining that global economic value has shifted over the last fifty years from tangible assets such as machinery, inventory, and physical resources toward intangible assets such as R&D, know-how, data, and software. Because intangible assets cannot simply be locked away like a factory or a car, technical inventions need patent protection to create an exclusion right over something non-physical. The moderator cited analysis showing that startups using patents and trademarks were 10 times more likely to obtain early-stage funding than those not using them, and were also more likely to scale and achieve successful IPOs or acquisitions.
